Domains

Domain names are part of the Internet's system of unique identifiers. The Internet Corporation for Assigned Names and Numbers (ICANN) is responsible for coordinating the registration of domain names. Applications for domain names are not filed with the Patent and Trademark office, but with an ICANN approved registrar.

Although domain names are similar to trademarks they are not the same thing. Having a trademark does not mean that you have a domain name. Having a domain name does not mean that you have a trademark. However if a domain name is used as a source indicator it is very likely being used as a trademark. Domain names are international in coverage, unlike trademarks which often must be filed in each jurisdiction in which they are used. Domains are generally available on a first to file basis, with the exception of bad faith registrations. Trademarks, on the other hand, at least in the U.S., are recognized on a first to use basis.

A domain attorney can not only help you register a domain name, but also advise you regarding trademark and copyright issues that are inherent in having a web site. A domain attorney may also assist in the procuring the return or enjoining the use of a domain that has been stolen, cybersquatted or otherwise registered in bad faith. A domain attorney may also help you negotiate licenses, sales and transfers of domains. If requested they will keep you apprised of when renewals and other filings are due and file the appropriate papers on your behalf.
