Department of Defense Manpower Data Center - refers to the organization that collects, archives, and maintains: manpower; personnel; and financial databases for the Department of Defense.

Dependent Claim - refers to a patent Claim that refers back to and thus further limits a preceding dependent or independent claim. Therefore, a dependent claim includes every limitation of the claim to which it refers back and is said to depend on such claim.

Derivative Work - refers to a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. Derivative works consist of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship.

Diamond album - refers to a certification mark awarded by the RIAA for a phonorecord that sells at least 10,000,000 units.

Digital Transmission - refers to a transmission in whole or in part in a digital or other non-analog format.

Dilution - refers to the lessening of the capacity of a famous mark to identify and distinguish goods or services, regardless of the presence or absence of(1) competition between the owner of the famous mark and other parties, or (2) likelihood of confusion, mistake, or deception.

Display - refers to showing a copy of a work, either directly or by means of a film, slide, television image, or any other device or process or, in the case of a motion picture or other audiovisual work, to show individual images nonsequentially.

Providing this information in the application data sheet constitutes the specific reference required by 35 U.S.C. 119(e) or 120, and § 1.78(a)(2) or § 1.78(a)(5), and need not otherwise be made part of the specification.
